The Victorian Actors’ Benevolent Trust (ABN 92 253 071 535) (‘VABT’, ‘us’, ‘we’, ‘our’) is a not-for-profit, charitable organisation providing emergency financial assistance and services to individuals within the Entertainment Industry.

User Agreement

Through use of this website and any of the VABT’s services, you accept the User Agreement, outlined as follows:

      1. This website may only be used for lawful purposes. Users are prohibited from using this website to publish, promote, disseminate or in any way otherwise undertake unlawful, harmful, defamatory, misleading or obscene actions or material. Such violation shall be as determined by the VABT or applicable local authorities. Any breach of this term may result in legal action or the involvement of the authorities. VABT reserves the right to block access to the site by any IP address connected to any person or their associates, known or reasonably suspected, who act in contravention of this provision.
      1. The VABT commits to taking all reasonable endeavours to ensure the information contained within this website is true and correct as at the date of publication, however the information contained within this website is subject to change without notice and while every effort is made to ensure it is accurate, may include typographical errors or inaccuracies.
      1. The VABT is not liable for the accuracy of any information extracted or obtained from this website and subsequently published, printed, stored or used in any way by any User other than the VABT.
      1. Any commercial use or exploitations of the whole or any part of this website, including information contained publicly and/or data stored securely, is prohibited. Any breach of this term may result in legal action or the involvement of the authorities.
      1. Photos, videos and all other forms of digital media contained on this website, including this website’s source code, are considered property of the VABT and are not to be copied, manipulated or extracted without prior consent being granted in writing by the VABT to the User.
      1. Use of this website and the VABT’s services is at the sole discretion of the User. The VABT accepts no liability for any computer viruses or damages incurred during the course of use. The VABT encourages all Users to take appropriate and adequate precautions to ensure their safety when online.
      1. This User Agreement is effective as of 28 September 2020. The VABT reserves the right to amend or make changes to this User Agreement as necessary, without notice. Continued use of this website will constitute acceptance of those changes.
      1. These terms and conditions, the use of this website and the transactions facilitated by it are governed by the laws of Victoria, Australia and you agree that the courts of the State of Victoria have jurisdiction in relation to all matters arising out of the use of this site.

Donations

Donations to the VABT made via this website, direct transfer, in person or any other means are governed by the following Terms and Conditions. Submission of a Donation to the VABT, irrespective of value, warrants acceptance of these Terms and Conditions:

      1. The VABT is a registered charity with:
        • The Australian Charities and Not-for-Profits Commission
        • The Consumer Affairs Victoria Fundraisers Public Register – FR0012370
      1. The VABT holds Deductible Gift Recipient Status with the Australian Taxation Office. All donations of AUD$2 or more are tax deductible.
      1. The VABT is a charitable organisation and all monies donated to the VABT are used for charitable purposes and the ongoing administration and standard operations of the VABT. The VABT reserves the right to distribute or otherwise use monies received at its sole discretion. Wherever possible, the wishes of Donors are considered and taken into account, but for the avoidance of doubt, unless otherwise separately agreed in writing, the VABT retains full discretion over the use of monies received.
      1. Refunds of donations may be available if clear evidence can be provided that the donation was made in error. Should you wish to request a refund, please email donate@vabt.com.au. Refunds will not be possible for change of mind.
      1. The VABT is committed to protecting your privacy and ensuring your information is secure. As such, the VABT takes all reasonable endeavours, including suitable physical, electronic and managerial procedures, to protect the information we collect. For further information on the collection, storage and disclosure of your personal details, see our Privacy Policy. Donors submitting a donation electronically, including through the provision of their credit card details via this website, do so at their own risk. The VABT accepts no liability for any unauthorised use or fraud of a Donor’s credit card details, nor any loss as a result of unauthorised use or fraud. In the unlikely event of unauthorised use or fraud, the VABT commits to taking all reasonable endeavours to assist, but for the avoidance of doubt, the credit card holder is solely responsible for notifying their card provider.
      1. The VABT does not generally disclose details relating to individual donations. However, in the event that the VABT determines a donation warrants public disclosure or recognition, we reserve the right to disclose the sum of the donation, but we will not disclose any identifying details related to the donation, including but not limited to your name, without first seeking and receiving your consent. For further information on the collection, storage and disclosure of your personal details, see our Privacy Policy.
      1. Should you elect to include an optional message of support with your donation, the VABT reserves the right to use this as an anonymous quote within VABT public communications at its discretion. The VABT will not attach or include any identifying details related to the quote, including but not limited to your name, without first seeking and receiving your consent.       1. For the avoidance of doubt, unless otherwise stated in writing at the time of donation, all monies donated via the VABT website, direct transfer, in person or any other means are for the sole use of the Victorian Actors’ Benevolent Trust (ABN 92 253 071 535).
      1. VABT keeps records of donations and expenditure as required by law. The public is entitled to inspection of records in accord with the provisions of the Fundraising Act 1998 (Vic.) and through the Australian Charities & Not-for-profit Commission website
      1. These Terms and Conditions relating to Donations are effective as of 19 February 2021. The VABT reserves the right to amend or make changes as necessary, without notice. Further donation will constitute acceptance of those changes.

Applying for Assistance

Applications for any form of Assistance or Support via the VABT website, email, phone, mail, in-person or any other means are governed by the following Terms and Conditions. Submission of an application for Assistance warrants acceptance of these Terms and Conditions:

      1. For the avoidance of doubt, Assistance is defined as the provision of any goods, service, resources or monies, by the VABT in response to an Applicant’s request. On occasion, the words “assistance”, “support”, “help”, “relief” and “aid” may be used interchangeably.
      1. Applicants warrant that any and all information provided to the VABT as part of an application for Assistance is provided truthfully and as accurately as their circumstances allow. Any efforts to deceive or wilfully mislead the VABT will immediately render void any Application, and may, at the VABT’s discretion, exclude the Applicant from any future application for Assistance.
      1. Notwithstanding the previous term, an Applicant reserves the right to withhold personal information from their application. In this instance, the VABT will take every reasonable action to consider the application to its fullest, including providing the Applicant an opportunity to provide further information, however should information be withheld, the VABT may not be able to determine the outcome of an application or provide the Assistance requested. For more information on the types of personal information collected during an application for Assistance, and the ways in which the VABT uses and stores this information, please see our Privacy Policy.
      1. The decision to approve or decline an application for Assistance is at the sole discretion of the VABT in consultation with its volunteer Committee of Management, as is the monetary value or extent of Assistance provided in the event an application is successful. Information on the current Committee of Management can be found at vabt.com.au/committee. All applications are assessed on a case-by-case basis. The number of Committee members assessing any given application is at the discretion of the Committee.
      1. The VABT is committed to equal opportunity for all. All applications are equitably assessed on a case-by-case basis.
      1. All applicants will receive correspondence confirming the result of their application, including applications that are unsuccessful. In the event of an unsuccessful application, an Applicant may request further information from the VABT as to why their application was unsuccessful, as well as request that their application be re-assessed. In either instance, the VABT will not unreasonably refuse. Except for instances as outlined in point 2 of these Terms, relating to efforts to deceive or wilfully mislead, an unsuccessful application for Assistance in no way precludes an Applicant from submitting future applications.
      1. The VABT reserves the right to add, amend, change or withdraw any and all forms of Assistance available at any given time. Any such addition, amendment, change or withdrawal shall be communicated via the VABT website.
      1. The VABT reserves the sole right to determine and set any Applicant criteria or eligibility requirements relating to the provision of Assistance. Such criteria or eligibility shall be clearly communicated via the VABT website at the point of application. The VABT reserves the right to add, amend, change or withdraw any and all Applicant criteria or eligibility requirements at any given time. Such changes shall be communicated via the VABT website.
      1. All applications and subsequent offers of Assistance are made on a private and confidential basis. Applicants may personally elect to share publicly that they have received support from the VABT, however it is a condition of Assistance that the reason Assistance was required, and the extent of the Assistance provided by the VABT, both remain confidential, unless otherwise agreed in writing by both the VABT and the Applicant.       1. Notwithstanding the previous condition, the VABT may disclose to the relevant authorities or service providers, details of an application or Applicant where required by law, or in exceptional circumstances where the Committee of Management determines that the Applicant is at risk of immediate harm.
      1. These Terms and Conditions relating to Applying for Assistance are effective as of 19 February 2021. The VABT reserves the right to amend or make changes as necessary, without notice. Further application for Assistance will constitute acceptance of those changes.

Shop

Purchases of goods or services from the VABT, including via the online Shop available on the VABT website, are governed by the following Terms and Conditions. Purchase warrants acceptance of these Terms and Conditions. Please note, the following does not apply to Donations, only purchases.

      1. Purchase of goods or services from the VABT are not permitted for resale, commercial use or exploitation.
      1. Refunds for a purchased goods or service are not available for change of mind. Items that are faulty or fail to match their description are eligible for replacement or possible refund under Australian Consumer Law. Should you wish to request a refund, please email enquiries@vabt.com.au.
